The Seller, DJ Kennel and the Buyer, _____________, hereby agree as follows:

1. The Seller hereby sells to the Buyer, for the amount of _$_______, payment of which is hereby acknowledged, a FEMALE /MALE puppy, born _____, by __ _, out of __________ in accordance with the terms of this contract as set forth below.

2. The Seller guarantees that the puppy is in good health on the date of delivery.

3. The Seller guarantees that the puppy is free of hereditary defects to the best of his/her knowledge.

4. The Seller makes no guarantee regarding loss of the puppy because of accidental death, theft, sickness, etc., or any other loss beyond Seller’s control, except as stated above. If the puppy develops any inheritable/genetic defects THAT ARE LIFE THREATINING within 1 (one) year from the date of birth, Buyer may return the puppy to seller for a replacement puppy selected by seller from a future litter. A replacement puppy is provided only upon return, by the Buyer, of the puppy or certificate of death by licensed veterinarian,sold under this contract. The cost of shipping the original puppy shall be solely the responsibility of the Buyer. The cost of shipping the replacement puppy shall be solely the responsibility of the Buyer. A replacement puppy is a replacement, not an additional puppy.

5. The Seller reserved the right to have a second veterinarian of his/her choice evaluate the puppy’s condition before the warranty shall be honored. Furthermore, under no conditions and at no time during the life of the puppy shall the Seller pay or assist in paying veterinary expenses after the puppy is purchased, including any such expenses directly or indirectly related to any inheritable/genetic defects.

6. The Buyer agree to have the puppy checked by a licensed veterinarian within five (5) days of receipt (excluding weekends). Furthermore, the Buyer shall provide the Seller with documentation evidencing such examination within 10 days of receipt of puppy. Failure to have such an examination performed and provide documentation to Seller shall render any guarantees contained herein null and void.

7. The Buyer understands that this Sales Contract is non-transferable. Should Buyer relinquish ownership of the puppy, for any reason, this Sales Contract shall immediately be rendered null and void.

8. The Buyer understands and agrees that although there are no plans at present time to stop breeding Puggles, Beagles, Boston Terriers or any other breed, the guarantees contained herein are valid only so long as Seller is still in the business of breeding said dogs. Should Seller cease breeding said dogs, for any reason, this Sales Contract shall immediately be rendered null and void.

9. In the event of a dispute, the State of Oklahoma, County of Adair, shall have sole jurisdiction over the matter.
